The defendant was charged with conspiracy to commit forgery-uttering, in violation of secs. 943.38 (1) (a) and 939.05 (2) (c), Stats. Trial was to the court, defendant having waived his right to a trial by jury. Judgment was entered and defendant was sentenced to an indeterminate term of not more than ten years. Motion for post-conviction relief was denied. Writ of error was issued to review the order denying post-conviction relief. The defendant, Donald E. Voigt, and Mrs. Diana L. Fuller were arrested at the Lincoln State Bank in Milwaukee on October 16, 1970, while attempting to pass as genuine a check which was later determined to be forged. The defendant and Mrs. Fuller were charged on the same complaint as parties to a conspiracy to commit the crime of forgery-uttering.
