b0604 By order of April 29, 1997, the application for leave to appeal was held in abeyance pending the decision in K & K Construction, Inc v Michigan Dep't of Natural Resources, (Docket No. 106712). On order of the Court, the decision having been issued on March 24, 1998, 456 Mich 570 (1998), the application is again considered. The motions to file briefs amici curiae are considered and they are GRANTED. The application is again considered, and it is DENIED, because we are not persuaded that the question presented should be reviewed by this Court. The result reached by the Court of Appeals is correct pursuant to this Court's decision in K & K Construction, Inc, supra. The Court of Appeals' analysis, particularly its reliance on Loveladies Harbor, Inc v United States, 28 F 3d 1171 (1994), is disavowed insofar as it is inconsistent with this Court's decision in K & K Construction.
